TRASDEM – Empowerment of social dialogue in trade sector as a contribution to the overarching EU employment and social policy challenges

ZAKLJUČNA KONFERENCA „TRASDEM” - 21. NOVEMBER 2013 ob 9.00 uri v Domu gospodarstva, Dimičeva 13, dvorana A, Ljubljana

Na BREZPLAČNI zaključni konferenci vam bodo strokovnjaki iz partnerskih držav Španije, Portugalske, Italije in Slovenije predstavili najnovejše zakonodajne novosti na področju delovno-pravne zakonodaje, ki naj bi omogočale zagotavljati večjo fleksibilnost delovnih procesov, ter zaposlovanje mladih, starejših in brezposelnih oseb. Predstavnica Eurocommerca iz Bruslja pa bo predstavila tudi najnovejše dogajanje na nivoju EU. Zakonodajne rešitve, ki jih lahko uporabljajo delodajalci v Republiki Sloveniji v praksi, bo predstavila strokovnjakinja za področje delovnega prava mag. Nataša Belopavlovič.

Udeleženci tega projektnega dogodka bodo prejeli brezplačni e-priročnik, ki bo vključeval novosti na trgu dela, ki se pripravljajo na ravni EU

Program in prijavnica

V projektu poleg Trgovinske zbornice Slovenije, ki je vodilni partner v projektu, sodelujejo tudi partnerji iz Španije, Portugalske, Italije ter evropskega združenja trgovcev Eurocommerce iz Bruslja. V posamezne aktivnosti projekta pa so vključeni tudi predstavniki sindikatov ter trgovskih podjetij iz navedenih EU držav.

S projektom želi TZS kot nosilec projekta prispevati k krepitvi socialnega dialoga v trgovinski dejavnosti v Sloveniji, v EU državah partnericah projekta ter tudi širše, to je na  evropski ravni preko Evropskih inštitucij. Rezultati projekta  naj bi prispevali k iskanju novih stališč, mnenj, argumentov in pristopov za modernizacijo delovnopravnega in socialnega področja po posameznih državah članicah EU ter posledično pripomogli tudi k izhodu iz ekonomske in finančne krize.

Cilji projekta:

  • povečati zavedanje o pomenu socialnega dialoga med socialnimi partnerji v Sloveniji, Italiji, Španiji in Portugalski z namenom uspešnega soočanja z izzivi na področju trgovinske panoge v EU,
  • pospeševanje implementacije evropske zakonodaje v predpise držav (predstavnikov v projektu),
  • povečevanje razumevanja pomena prožnosti med socialnimi partnerji,
  • oblikovanje in izvajanje mednarodnega sodelovanja med socialnimi partnerji v Sloveniji, Italiji, Španiji in Portugalski ter evropskimi inštitucijami, ki bo prispeval k krepitvi socialnega dialoga na evropski ravni,
  • vključevanje evropske prakse na področju socialnega dialoga med partnerje v projektu.

Partnerji se bodo v okviru fleksibilnosti, kot jo opredeljujejo izhodišča projekta, osredotočili na sledeča področja:

  • modernizacija trga dela,
  • kakovost dela,
  • mobilnost in migracije,
  • zaposlovanje mladih,
  • aktivno staranje,
  • aktivno vključevanje v delo ter primerno delo.

Project TRASDEM - english presentation

TRASDEM is an initiative of institutions representing employers which is supported by trade unions. Aim is to empower social dialogue in Slovenian, Italian, Spanish and Portuguese trade sector as we have to combat employment and social policy challenges to reach goals set on European level (like Europe 2020, EES) to boost sustainable economy growth. Bilateral social dialogue will have a transnational dimension. Results will be disseminated to national tripartite social dialogue bodies and to European institutions and bodies. Topics where will seek progress in social dialogue are: flexicurity, modernisation of the labour market, quality of work, anticipation, preparation & management of change & restructuring, mobility & migration, youth employment, active ageing, active inclusion & decent work. Attention will be given also to promotion of equal participation of women & men in the decision-making bodies of trade unions & employer’s organisations and to synergies between sectoral committees and inter-professional level.

Initiative seeks for new arguments, options, approaches, methods which can support measures to exit from the economic crisis and to modernise related systems. Activities will be organised on transnational, national and sectoral level with participation of employers, employees, sectoral, national institutions and bodies’ representatives. Main expected results are: epublication in 5 languages, articles and sub-website, 4 national surveys, findings and recommendations, 12 national round tables, international workshop, study visit, international closing conference, strengthened capacities of social partners and strengthened international cooperation. Surveys will contain also impact assessment of the employment and social dimensions of EU initiatives.

Objectives of the project:

  • Raise awareness and strengthen capacities of social partners in Slovenia, Italy, Spain & Portugal about European social dialogue with aim to combat challenges in the European trade sector.

Outcomes of the project
The following results and outputs are expected by the end of the TRASDEM action:
1. 1 international kick-off meeting in Slovenia for representatives of all project partners.
2. 1 networking day in Brussels (planned by the call) – attendance of 2 TZS experts.
3. 1 Study visit to Denmark (participants of CCP, CCC, SDGZ, TZS and one representative from their trade unions).
4. 1 international workshop in Spain for representatives of CCP, CCC, SDGZ and TZS.
5. 1 international closing conference in Slovenia (wider audience and presence of all project partners: cca. 100 participants, interpretations ensured).
6. 4 surveys: preparatory or the input documents as an assessment of state about social dialogue in trade sector with emphasis on the content of the project (countries: Slovenia, Italy, Spain & Portugal).
7. 1 integrated survey in English language which will be included into e-publication.
8. 12 roundtables with national institutions & bodies representatives (3 round tables per country with a survey).
9. 6 web sites containing information about the project in national language and documents in English language. TZS will maintain the project website in English language.
10. 1 presentation of Danish good practice and know how related to the project topics.
11. 1 presentation of EuroCommerce: current situation regarding the project topics at the EU level.
12. 1 Findings and recommendations (will be included into e-publication) which will be given to relevant national and EC bodies, European Economic and Social Committee, etc
13. 1 e-publication consisting of all major documents (in English, translations into Slovene, Italian, Spanish & Portuguese languages).
14. 10 articles in TZS T-information bulletin in Slovene language.
15. 1 guideline for preparation of evaluation.
16. 1 methodology for preparation of national surveys.

Results will be subject of action’s continuing dissemination.

Kick off meeting, Ljubljana 17. - 18. 1. 2013
Od 17. – 18. januarja 2013 je v Ljubljani, Slovenija  potekal kick off meeting vseh partnerjev v projektu TRASDEM. Prvi dan sestanka je bil namenjen predstavitvi projektnih partnerjev, seznanitvi partnerjev s projektom, vlogi partnerjev v projektu ter finančnimi pravili projekta ter določitvi naslednjih aktivnosti vseh deležnikov v projektu.

Drugi dan srečanja  je bil namenjen predstavitvi zadnjim dogajanjem na EU ravni na področju socialnega dialoga oziroma na vseh področjih, ki jih pokriva projekt TRASDEM, ki jih je predstavila ga. Ilaria Savoini iz Eurocommerce, Bruselj.

At the kick-off meeting where all the partners will be present, we will introduce the project, its goals & results, partners roles, financial rules in the project and the latest developments/documents at the EU level in connection with the modernization of the labour market, flexicurity, youth employment and employment of elderly people, quality of work&mobility and migration. Each representative of the partners is expected to present itself and its organisation.

Študijski obisk na Danskem - Kopenhagen 4. 3. - 6. 3. 2013 / Study visit - Copenhagen, Denmark 4. 3. - 6. 3. 2013

Uspešno izveden študijski obisk Asociacije delodajalcev Danske – Kopenhagen, Danska 4. 3. - 6. 3. 2013

V sklopu aktivnosti na Projektu TRASDEM, je bil v začetku meseca marca 2013 izveden študijski obisk Asociacije delodajalcev Danske ter Danske trgovinske zbornice. Študijskega obiska so se udeležili kot partnerji v projektu predstavniki Portugalske konfederacije trgovine in storitev, Konfederacije trgovine iz Katalonije, Španija, Slovenskega deželnega gospodarskega združenja v Trstu, Italija ter predstavniki Trgovinske zbornice Slovenije kot vodilni partner v projektu. Prav tako so se študijskemu obisku pridružili predstavniki sindikatov iz Španije, Portugalske in Slovenije.

Namen obiska je bila predstavitev modela dobre prakse s področja delovnopravne zakonodaje, socialnega dialoga s poudarkom na varni prožnosti ter stalnim izobraževalnim sistemom delavcev na Danskem ter možnost prenosa predstavljenih dobrih praks v države partnerice projekta- Slovenijo, Španijo, Portugalsko in Italijo.  Študijski obisk je bil tudi priložnost za izmenjavo informacij partnerjev v projektu glede različnih ureditev posameznih delovnopravnih inštitutov v posameznih nacionalnih zakonodajah.

Ob zaključku študijskega obiska so se vsi udeleženci strinjali, da je bil obisk dobra priložnost za podrobno seznanitev s primeri dobrih praks na Danskem,  izmenjavo izkušenj med udeleženci ter navezavo poslovnih stikov in je tako absolutno dosegel svoj namen.

Study visit in Denmark- Copenhagen 4. 3.- 6. 3. 2013

Due to the Project TRASDEM working schedule, partners and the leading partner of the project attended 3 days study visit at Confederation of Danish Employers in  Denmark -  Copenhagen in March 2013. The study visit also included meetings with the prepresentatives from  the Danish Chamber of Commerce and meeting with Trade Union representative from HK Privat in Denmark.

The study visit was attended by the representatives of Portuguese Commerce and Services Confederation, Portugal, Confederation of Commerce of Catalonia, Spain, Slovenian Regional Business Association from Trieste, Italy and Slovenian Chamber of Commerce, Slovenia. According to the aim of the visit, the representatives from trade unions in Slovenia, Portugal and Spain also took place at the meetings durign the study visit.

One day of the 3 day studiy visit was also intended for the project meeting of the partners in the project. The aim of the study visit was presenting the good practice model in Denmark regarding the social dialogue, labour law- especially the topic of flexicurity, quality of work, management of change, restructuring, mobility and migration, active inclusion and decent work and finding ways for transfer of above mentioned topics into countries - partners of the project: Spain, Slovenia, Portugal and Italy. The study visit was also a great opportunity for the project partners to exchange information, experiences and practice models in each country in a debates which accompanied the presentations each day of the study visit.

Networking day v Bruslju, 22. 3. 2013/ Networking day, Brussels, 22 March 2013

Na podlagi povabila Evropske Komisije, DG Employment, Social Affairs and Inclusion, se je TZS v okviru Projekta TRASDEM udeležila »Networking day for project promoters«, ki je potekal dne 22. 3. 2013 v Bruslju. Na sestanku so bile predstavljene informacije o vseh sprejetih projektih, ki trenutno potekajo. Prav tako je bilo srečanje namenjeno predstavitvi posameznih projektov, povezovanju in vzpostavitvi stikov med nosilci posameznih projektov ter možnosti sodelovanja v prihodnje, obenem pa so bila na sestanku podana posamezna dodatna pojasnila, ki se nanašajo na administrativno in finančno vodenje projektov.

Project manager for the Project TRASDEM  took part at the Networking day for project promoters which took place on 22 March 2013 in Brussels. The objectives of the meeting were to foster networking among project promoters- for better collaboration, cross-fertilization, exchange of goog practice and dissemination. Teh meeting was aslo the opportunity to provide information on the administrative and financial management of the projects and also gave the possibility for face to face contacts between project managers and EC.

Uspešno izvedena okrogla miza 2013 - 20. 3. 2013 / First national round table 20. 3. 2013

V okviru izvajanja aktivnosti v okviru projekta TRASDEM je TZS v mesecu marcu 2013 uspešno izvedla prvo nacionalno okroglo mizo, ki so se je udeležili predstavniki delodajalcev ter sindikatov. V okviru okrogle mize so bile predstavljene udeležencem  dobre prakse socialnega dialoga ter področja fleksibilnosti delovno pravnega področja v okviru pridobljenih znanj iz študijskega obiska na Danskem. Udeleženci so imeli možnost diskusije ter iskanja možnosti uvedbe primerljivega modela v slovensko zakonodajo. Prav tako je bila udeležencem predstavljena sistematika oziroma model, ki predstavlja osnovo za drugo in tretjo nacionalno okroglo mizo ter, podlagi zaključkov teh ugotovitev pa bo z vključenim prispevkom ostalih partnerjev v projektu (Italija, Španija, Portugalska) oblikovala končna verzija predlogov in možnosti prenosa dobrih praks s področja fleksibilnosti delovne sile ter trga dela iz Danske v Slovenijo oziroma v preostale partnerske države.

First national round table 20.3.2013

Slovenian Chamber of Commerce sucessfuly organised first national round table on 20. 3. 2013. Participants at the round table came from employeers and trade unions organisations. The SCC presented the participants the good practice model from Denmark regarding the Danish social dialogue practices and flexicurity, modernisation of the labour market, mobility, migration, youth employment, education at work, active aging and decent work practices. The participants also disscused the possibility of transfer of gained information from above mentioned topics into Slovenian legislation and fixed the topics to be discussed at the second and third national round table in May and June 2013.

Uspešno izvedena 2. nacionalna okrogla miza dne 15. 5. 2013/Second National Round table 15 May 2013

V okviru projekta je TZS kot vodilni partner v projektu izvedel drugo nacionalno okroglo mizo, ki so se je udeležili predstavniki delodajalskih  ter delojemalskih organizacij. Udeleženci so obravnavali predlog gradiva »Round Table Platform« in oblikovali usmeritve za mednarodno delavnico v Barceloni, ki bo potekala v juniju 2013 pri španskih projektnih partnerjih- Konfederaciji trgovine Katalonije (CCC).
     
SCC organized 2nd National Round Table which took place on 15 May 2013 with participants from employers and employees organisations. The discussion was focused on the Round Table Platform document and on preparation the suggestions and outlines for the international workshop which will take place in June in Barcelona at the Confederation of Commerce of Catalonia (CCC).

V okviru projekta TRASDEM - Krepitev socialnega dialoga v trgovinski dejavnosti kot prispevek h ključnim izzivom pri zaposlovanju ter socialni politiki v EU je bila v začetku junija izvedena mednarodna delavnica, ki je potekala na sedežu španskih projektnih partnerjev Konfederaciji trgovine iz Katalonije v Barceloni. Del obiska je bil namenjen tudi sestanku projektnih partnerjev, na katerem so bile natančno opredeljene prihodnje aktivnosti partnerjev ter finančno vodenje projekta.

V okviru mednarodne delavnice so sodelovali predstavniki projektnih partnerjev iz Trgovinske zbornice Slovenije, Slovenskega deželnega gospodarskega združenja v Trstu, Italija, Konfederacije trgovine iz Katalonije, Barcelona, Španija in Portugalska konfederacija trgovine in storitev iz Lizbone, Portugalska. Sodelujoči partnerji so med drugim predstavili statistične podatke, ki se nanašajo na trgovinski sektor po posameznih državah ter rezultate izvedenih dveh okroglih miz v posameznih državah partnericah projekta ter oblikovali skupna izhodišča za izvedbo okroglih miz v juniju/juliju. Rezultati navedenih srečanj in razprav pa bodo osnova za skupno e-brošuro, ki bo predstavljena na zaključni konferenci v Ljubljani v novembru 2013. V okviru obiska so udeleženci obiskali tudi Delovno sodišče Katalonije.

INTERNATIONAL WORKSHOP AND PROJECT MEETING IN BARCELONA: 3 JUNE - 5 JUNE 2013

The project partners of the Project TRASDEM took part at the international workshop and project meeting, which took part at the Confereration of Commerce of Catalonia in Barcelona, Spain.

Goals of the international workshop

The aim of the International workshop in Spain focuses on two national round table already executed in spring which took place in partners countries and the outcomes at partners associations (Italy, Spain, Portugal and Slovenia) and is dedicated to the expert debate about findings and recommendations of national round tables regarding the empowerment of social dialogue in trade sector as a contribution to the overarching EU employment and social policy challenges, taking into account the good practice model presented at the study visit in Denmark in March 2013 where all the project partners together with the representatives from trade unions from Spain, Italy, Portugal and Slovenia took part.

Main Conclusions from the first day of the worshop

After the welcome from representatives of the CCC, Barbara Gnilšak, SCC introduced the agenda for the international workshop and project meeting. Andrej Trdina from SCC presented the latest statistical data regarding the trade sector in Slovenia which are different from the given information in March at the study visit in Copenhagen, Denmark. All the participants also gave oral comments and short reports about the latest statistical data regarding the latest developments in the trade sector.

Each project partner presented the outcomes and recommendations from the 2 national round tables which took part after the study visit in Denmark. At the two national round tables per each project partner, first good practice model from Denmark was presented to the representatives from employees and trade unions and secondly, the participants tried to find main problems in national legislation regarding the following topics:

- flexicurity
- maternity leave
- part time job/full time job
- fixed term contracts/unfixed term contracts
- bonuses
- sick leave
- holidays
- quality of work
- periods of notice
- severance pay, etc…

The outcomes from the national round tables from each project partner were presented following the guidelines already sent from the project partner after the study visit in Copenhagen in March 2013 which enabled the participants the proper and useful tool to easily compare the outcomes of the findings and the right base for the discussion which followed the presentations. All the presentations are available for the project partners and also for trade unions and a wider public at the web side of SCC and will also be sent after the meeting to the project partners by e-mail.

Outcomes of the presentations and joint findings of the project partners

After the presentations the participants shared the opinion that there are quite big differences between the legislations/collective agreements of the participating partners. The partners shared their views that in the partners countries the labour legislation has already been changed since the beginning of the project in December 2013 and it is most likely that until the end of the project in November 2013 there will be further changes. At the end project partners were given the opportunity to give proposals for the improvement of the project management and organisation. At the end of first day, evaluation forms were distributed among the participants for the evaluation of the meeting.

Visit of the Labour Court of Catalonia

The second part of the meeting was scheduled at Labour Court of Catalonia (Tribunal Laboral de Catalunya - TLC) at their premises in Barcelona. Representatives of the TLS first introduced their organization which is a non-profit organization, funded by Government of Catalonia. TLC offers extrajudicial system for solving labour conflicts. These conflicts can be resolved through conciliation, mediation or arbitrage. Proceedings for each procedure are different, but the goal is to find fast and efficient solution. TLC is available to all employees and employers in Catalonia who are signatories of a collective agreement. TLC representatives especially emphasized the growing number of conflicts – in the year 2000 there were 483 disputed filed in while in 2012 there were over 1.000 conflict filed in. Over 50% of all disputes end with an agreement. Comparing the number of files by sectors, it is evident, that the largest share of all files come from metal sector, second largest is education sector and the third largest is health sector. 

Discussion among project partners that followed the presentation revealed, that similar procedures exist in no other country than in Spain. The participants at the meeting also got a PPT presentation of the Labour Court of Catalonia.

Project meeting

Barbara Gnilšak informed the partners about the evaluation of the executed tasks on the project, next steps of the project in the near future and all the task which must be done till the end of the project and all the remaining open questions regarding the content of the project.  The PPT presentation are sent to the participants/project partners after the meeting and are available on the web page of SCC/ TRASDEM project.

Also the financial management of the project was presented to the participants, especially with the emphasis on the open questions which were resolved during the meeting in Copenhagen and next steps still to be accomplished regarding the obligation of the leading partner to ask for the second prepayment to the EU Commission which will be done in June/July 2013 . The participants will receive all PPT presentations regarding the financial issues of the project by mail.

Main conclusions of the project meeting:

  • all PPT presentations from the workshop and project meeting will be sent to the participants by mail and will be available on the web page of the project of SCC and on all the project partners webpages
  • participants will receive the minutes of the workshop/project meeting
  • leading partner will prepare the joint document which will include all the presented findings of the project partners in Barcelona and will serve as a help and tool for the 3rd national round tables
  • project partners will sent all the still missing expences claims to the leading partner in a short time so that SCC can ask the EU Commission for the second prepayment
  • partners must execute the 3rd national round table till 15 July 2013
  • partners must send the leading partner minutes and attendance lists
  • (copies in scan) from the 2 national round tables already executed in a short time
  • all information and open questions are resolved in a short time by mail correspondence

All the partners were asked to express their opinion about the financial management of the project. According to the feedback of the project partners, the financial management of the project is satisfactory. The leading partner is trying to act quickly to reply all the questions by mail and phone regarding the expences and staff costs claims from the partners. At the end of the second day of the meeting, evaluation forms were distributed among the participants which will serve for the evaluation process.

Uspešno izvedena 3. nacionalna okrogla miza dne 16. 7. 2013 / Third National Round Table 16 July 2013

V okviru projekta je TZS kot vodilni partner v projektu v juliju 2013 izvedel tretjo nacionalno okroglo mizo, ki so se je udeležili predstavniki delodajalskih  ter delojemalskih organizacij. Udeleženci so obravnavali predstavitev ugotovitev in zaključkov mednarodne delavnice v Barceloni, ki je potekala od 3. 6. – 6. 6. 2013, prav tako pa je bila razprava namenjena različnim ureditvam posameznih institutov s področja delovnopravne zakonodaje v posameznih državah projektnih partnerjev ( Italija, Španija, Portugalska, Slovenija) ter na Danskem.
     
SCC as a leading partner in the project, organized 3rd  National Round Table which took place on 16 July 2013 with participants from employers and employees organisations. The discussion was focused on the presentations of findings and conclusions from the international workshop which took place from 3. 6. to 6. 6. 2013 in Barcelona, Spain at the Confederation of Commerce of Catalonia. The participants also discussed different legislative arrangements regarding labour law in different countries of project partners ( Spain, Portugal, Slovenia, Italy) and in Denmark.
